The media declared Joe Biden the President-elect and now Biden is starting to act like the Commander-in-Chief.

But now Biden is facing a massive setback.

And now this Supreme Court Justice’s threat was bad news for Joe Biden.

Justice Samuel Alito is one of the most conservative members of the Supreme Court.

In a speech to the Federalist Society, Justice Alito sent a message to Joe Biden and other pro-lockdown and pro-mask mandate tyrants that the new conservative majority on the court has little patience for the imperial rule by elected officials in the name of stopping the spread of the coronavirus.

Rule by executive fiat did not start with the overhyped panic surrounding the coronavirus.

After Republicans thrashed the Democrats in the 2014 midterms and won a Senate majority, Barack Obama boasted that he would govern by executive order claiming he had a “pen and a phone.”

But Alito declared that the coronavirus pandemic “highlighted disturbing trends that were already present before the virus struck.”

Alito attacked officeholders for attacking liberty by imposing sweeping restrictions on their constituents that closed businesses, imposed curfews and mandated masks without obtaining the consent of the governed by working with people’s elected representatives to arrive at a legislative solution.

“One of these is the dominance of lawmaking by executive fiat, rather than legislation. The vision of early-20th century progressives and the New Dealers of the 1930s was that policymaking would shift from narrowminded elected legislators to an elite group of appointed experts. In a word, that policymaking would become more scientific. That dream has been realized to a large extent. Every year, administrative agencies, acting under broad delegations of authority, churn out huge volumes of regulations that dwarf the statutes enacted by the people’s elected representatives. And what have we seen in the pandemic? Sweeping restrictions imposed, for the most part, under statutes that confer enormous executive discretion,” Alito added.

Dr. Fauci recently criticized Americans for rejecting the dictates of unelected so-called health “experts” and power-mad governors barking that “now is the time to do what you’re told.”

Justice Alito rejected that imperious attitude pointing out that the pandemic “highlighted the movement toward rule by experts” as opposed to elected officials working within the framework of the Constitution to legislate on behalf of the American people and then facing the voters in two or four years to answer for their decisions.

Justice Alito qualified his comments claiming that he was not commenting on the constitutional merits of any of these coronavirus restrictions.

If Joe Biden takes over in January, Biden’s incoming chief of staff, former asbestos lobbyist Ron Klain, revealed Biden’s first order of business would be a national mask mandate.

And Biden’s top coronavirus taskforce advisor Michael Osterholm is floating the idea of a four to six week national lockdown.

But Alito made it clear that the new conservative Supreme Court majority may not look kindly on these liberty-stealing decrees.
