Democrats are running into one obstacle in their quest to jail Donald Trump.

Justice Department guidelines prevent a sitting President from being indicted.

But one key Democrat just found a way to get around that and throw Trump behind bars.

California Democrat Adam Schiff is one of Trump’s chief nemesis in Congress.

The incoming chair of the House Intelligence Committee is a constant presence on CNN where he spreads fake news conspiracy theories about the Russian collusion hoax.

But his latest appearance on the Situation Room with Wolf Blitzer presented a new front in his war on Trump.

In light of Michael Cohen claiming Trump directed him to make hush money payments during the 2016 campaign to two women claiming affairs with Trump, Schiff’s new crusade is to pressure the Justice Department to drop its guidelines against indicting a sitting President.

“I think the Justice Department needs to reexamine that OLC opinion, Office of Legal Counsel opinion, that you cannot indict a sitting president under circumstances in which the failure to do so may mean that person escapes justice,” the California Democrat roared.

Many experts believe prosecutors in the Southern District of New York are waiting to see if Trump loses re-election in 2020 so they can indict him before the statute of limitations expires in 2021.

But Schiff is unwilling to wait.

Most Constitutional scholars agree that prosecutors cannot indict a sitting President.

In 2000, the Office of Legal Counsel in Bill Clinton’s Justice Department reaffirmed a 1973 OLC memo which stated that a sitting President could not be indicted.

The then-assistant attorney general Randolph D. Moss wrote that a “criminal process would impose burdens upon a sitting President that would directly and substantially impede the executive branch from performing its constitutionally assigned functions, and the accusation or adjudication of the criminal culpability of the nation’s chief executive by either a grand jury returning an indictment or a petit jury returning a verdict would have a dramatically destabilizing effect upon the ability of a coordinate branch of government to function.”

Schiff – as well as many other Democrats – know Robert Mueller has found nothing on Russian collusion.

They also know they will never have the two-thirds supermajority necessary in the Senate to vote to convict Trump of impeachment unless Trump faces catastrophic legal jeopardy.

So they turned their gazes on what they see as a receptive audience in the Department of Justice.

The DOJ is a hive mind of anti-Trump resistance.

Career Deep State prosecutors in the Southern District of New York fabricated these preposterous campaign finance “violations” to lay a trap for the President.

The next step is pushing enough of the American people to accept the spectacle of a sitting President standing trial.

Schiff used his time on CNN to send out smoke signals to Deep State career employees in the Justice Department that they will have political cover if they change their guidelines.

“If it were the case that it was now or never … that if you wait until after the president leaves office they can no longer be brought to justice, that ought to create certainly an exception to that OLC rule,” Schiff said.

“I don’t think the Justice Department ought to take the position — and it’s certainly not one that would be required in any way by the Constitution — that a president merely by being in office can be above the law, can escape the enforcement of the law, by essentially waiting out the law, by waiting out the statute of limitations,” Schiff continued.

Schiff and other Democrats know that indicting Trump – even on fake charges – would be the straw that breaks the camel’s back for many Republicans.

Establishment Republicans hate Trump.

They never wanted him to win in the first place.

But they stand by him because the President commands the loyalty of the GOP base.

However, swamp Republicans would betray the President in a heartbeat.

And Schiff’s strategy of pushing the DOJ to indict Trump may be the most sinister method yet.
