“Lois Lerner had yet another personal email account used to conduct some IRS business, the tax agency confirmed in a new court filing late Monday that further complicates the administration’s efforts to be transparent about Ms. Lerner’s actions during the tea party targeting scandal,” The Washington Times reports.

“The admission came in an open-records lawsuit filed by Judicial Watch, a conservative public interest law firm that has sued to get a look at emails Ms. Lerner sent during the targeting.”

“In addition to emails to or from an email account denominated ‘Lois G. Lerner‘ or ‘Lois Home,’ some emails responsive to Judicial Watch’s request may have been sent to or received from a personal email account denominated ‘Toby Miles,’” IRS lawyer Geoffrey J. Klimas revealed to Judge Emmet G. Sullivan.

Klimas says “Toby Miles” is an alias used to create “a personal email account used by Lerner.”

The email address created by Lerner was [email protected]

It is a felony to use private email accounts to evade public disclosure laws.

“It is simply astonishing that years after this scandal erupted we are learning about an account Lois Lerner used that evidently hadn’t been searched,” said Judicial Watch President Tom Fitton.

In addition to the secret email, the IRS has also been caught hiding backup tapes of her official email account.

The IRS claimed no tapes existed, but investigators quickly discovered them.

The “Toby Miles” email was listed in a criminal referral from the House Ways and Means Committee to the Justice Department, demanding a criminal investigation of Lerner’s conduct.

Lerner had forwarded emails to the address, which officials at the time were not aware was her own.

Fitton laid out the Obama administration’s crimes in the matter:

It is remarkable that the Obama IRS and Justice Department waited two years to tell a federal court that Lois Lerner had a separate email account that contains documents at issue in the IRS scandal.  Especially since both agencies knew about this account since April of last year.

It could be a crime if Lois Lerner kept confidential taxpayer data on her non-governmental email account.

This new disclosure follows the Obama administration’s Nixonian practice of “modified limited hangouts” of information about its IRS scandal and Lois Lerner “lost and found” emails. Every step of the way, the Obama IRS has obstructed this court’s orders to get Lois Lerner’s emails recovered and searched.

The Court has already threatened contempt against both IRS Commissioner John Koskinen and Justice Department attorneys over the Lerner email issue.  And I suspect that Judge Sullivan won’t be pleased by this latest revelation.
